INEC Set to Prosecute Adamawa State REC for Electoral Offences

The Independent National Electoral Commission (INEC) has announced its intention to commence the prosecution of Adamawa State Resident Electoral Commissioner (REC), Hudu Yunusa Ari, in accordance with the provisions of the Electoral Act 2022. Following its weekly meeting, INEC resolved to file a six-count charge against Ari at the Adamawa State High Court in Yola. The trial is set to begin on Wednesday, July 12.

In a statement issued by Festus Okoye, National Commissioner and Chairman of the Information and Voter Education Committee, INEC confirmed the receipt of case files from the Nigeria Police, concluding their investigation into alleged electoral offenses during the 2023 General Election. The commission assured the public of immediate action on the matter.

Citing Section 145(1) of the Electoral Act 2022, the statement clarified that offenses committed under the Act are triable in either a Magistrate Court or a High Court of the State where the offense occurred, or in the Federal Capital Territory, Abuja. Section 145(2) further specifies that the prosecution of such offenses shall be carried out by legal officers of the Commission or appointed legal practitioners.

After reviewing the case file from the Police, which established a prima facie case against Barr. Hudu Yunusa Ari, INEC has filed a six-count charge against him at the Adamawa State High Court in Yola. The trial is scheduled to commence on Wednesday, July 12, 2023. Additionally, the commission is collaborating with the Nigerian Bar Association (NBA) to ensure the diligent prosecution of other similar cases.
