“Federal Government Retreats from Contempt Action Against NLC and TUC, Averts Potential Strike

In a bid to avert a nationwide industrial strike by organized labor, the Nigerian federal government has reversed its course on pursuing contempt proceedings against the Nigeria Labour Congress (NLC) and Trade Union Congress (TUC).

Last week, the government, represented by the Federal Ministry of Justice, had threatened legal action against the labor leaders for alleged non-compliance with court orders restraining them from staging an industrial strike. The unions were accused of carrying out public protests on August 2nd, 2023, against the fuel subsidy removal despite the court orders.

Responding swiftly, the NLC convened an emergency National Executive Council Meeting in Abuja, warning of a nationwide strike if its leaders were taken to court for contempt.

In a letter addressed to Femi Falana, the lead counsel for NLC, the Solicitor General of the Federation, Mrs. B.E. Jeddy-Agba, confirmed the withdrawal of the contempt proceedings. The decision was reportedly influenced by President Bola Ahmed Tinubu’s intervention and the labor unions’ decision to call off their strike following discussions with the President and National Assembly leaders.

The letter acknowledged that the non-issuance of a crucial legal form rendered the contempt proceedings incomplete. It also emphasized that the issues raised by NLC’s communique had become irrelevant due to changing circumstances.

The Solicitor General highlighted the government’s concern for safeguarding the court’s integrity and preventing disruption of services and public facilities. The initial initiation of contempt proceedings was based on the unions’ violation of court orders and their participation in public protests that led to the closure of the National Assembly’s gate.

The episode underscores the delicate balance between labor rights and legal procedures, and how swift resolutions can mitigate potential strikes and disturbances.”
